1. Agreement to Terms
These Terms of Service (“Terms”) govern the provision of lawn mowing, gardening, property assistance, car detailing, moving services, and other agreed services (“Services”) by Helping Hands Property Care (“we”, “our”, “us”) to the customer (“you”, “your”).
By engaging our Services, you agree to be bound by these Terms, our Refund & Service Completion Policy, and all applicable laws, including the Australian Consumer Law (ACL).
2. Scope of Services
Services will be provided in accordance with the written service agreement, subscription plan, or booking confirmation issued to you.
We do not provide services outside the scope of the written agreement unless a new agreement is made in writing.
Any verbal requests, while considered, will not be binding unless confirmed in writing.
3. Service Scheduling & Access
Services will be scheduled at mutually agreed times.
You must provide safe, reasonable access to the property. If access is denied, unsafe, or delayed due to your actions, we reserve the right to reschedule or charge for lost time.
We are not liable for delays caused by weather, traffic, emergencies, or other circumstances beyond our control.
4. Payments
Payment terms will be set out in your service agreement, invoice, or subscription plan.
Payments are due in full by the date stated on the invoice unless otherwise agreed.
Late payments may attract additional fees or suspension of services.
All prices include GST where applicable.
5. Subscription Services
Subscriptions are billed monthly and automatically renew unless cancelled with at least 7 days’ written notice before the next billing cycle.
Refunds will only be provided if no work has been completed in that billing period (see Refund Policy).
If work is incomplete, we will return to finish it at no extra cost, rather than issuing a refund.
6. Cancellation & Rescheduling
One-off bookings must be cancelled or rescheduled at least 24 hours before the scheduled service time. Cancellations made later may incur a fee equal to up to 50% of the service cost.
Subscription cancellations must be made in writing at least 7 days before the next billing cycle.
We reserve the right to reschedule services due to weather, unsafe conditions, or operational reasons.
7. Service Completion Guarantee
If services are not completed in accordance with the written service agreement, we will return and complete the work at no additional cost.
This guarantee applies only to the agreed scope and does not cover additional requests or scope changes.
8. Customer Responsibilities
You must:
Provide clear, safe, and lawful access to the property.
Remove or secure pets, vehicles, and belongings that may interfere with work.
Inform us of hazards such as uneven ground, pests, chemicals, or other risks.
We are not liable for damage or delays resulting from your failure to provide safe and reasonable conditions.
9. Health & Safety
We reserve the right to refuse or suspend work if conditions are unsafe (e.g., dangerous animals, hazardous terrain, poor weather).
Customers are responsible for ensuring the property environment is reasonably safe for our workers.
10. Limitations of Liability
To the fullest extent permitted by law:
We are not liable for indirect, incidental, or consequential loss, including (but not limited to) loss of profit, emotional distress, or dissatisfaction beyond the agreed written scope.
Our total liability for any claim is limited to either:
Resupply of the services, or
Payment of the reasonable cost of having the services supplied again.
We are not liable for delays or cancellations caused by events outside our control.
11. Dispute Resolution
If you are dissatisfied with our services, you must notify us in writing within 7 days of the service being performed.
We will make reasonable efforts to resolve disputes quickly and fairly.
If resolution cannot be reached, disputes may be referred to the ACT Civil and Administrative Tribunal (ACAT) or another relevant authority.
12. Australian Consumer Law
Nothing in these Terms excludes or limits your rights under the Australian Consumer Law. You are entitled to services that:
Are provided with due care and skill.
Are fit for their intended purpose.
Match the description given to you.
Where a major failure occurs, you are entitled to remedies under the ACL, which may include resupply of services or compensation.
13. Amendments to Terms
We may update these Terms from time to time. Any changes will be effective immediately upon being published on our website or provided to you in writing.
